Student Information and Rights Regarding ICE Activity

We are aware that recent news about Immigration and Customs Enforcement (ICE) activity has raised questions and concerns among students and their friends. The information below has been posted around Nichols Hall and is based on a February 4, 2026 Kansas State Collegian article regarding campus immigration protocol and student rights. I am also currently waiting for official confirmation about which campus offices or contacts students should reach out to if they are dealing directly with ICE, and will share that information as soon as it is available.

Please feel free to speak to a Theatre faculty member with your concerns or questions.

Current reported university protocol and student rights information:

• The university states it will continue to comply with FERPA (the Family Educational Rights and Privacy Act).
• Student records are not released without written student consent or a lawfully issued subpoena, warrant, or judicial order.
• Immigration enforcement officers are not permitted to enter nonpublic campus areas without proper legal authorization.
• Nonpublic areas can include residence halls, faculty and staff offices, certain research labs, and health or counseling facilities.
• Federal officers are subject to the same access restrictions and university protocols as others when entering restricted campus spaces.
• The most recent university update cited indicates there is no current information showing an increase in immigration enforcement activity on K-State campuses.

General Know Your Rights reminders when interacting with ICE or other federal officers:

• You have the right to remain silent.
• You may ask if the officer has a warrant.
• You can ask to see the warrant. A judicial warrant should be signed by a judge.
• You do not have to consent to a search without a valid warrant.
• You may ask to speak with an attorney.
